1. Scope of application
These General Terms and Conditions apply to all contracts between guest and the Boardinghouse City Home-Bielefeld, owner/operator Mr. Selahattin Gültekin, Jöllenbeckerstr.36, 33613 Bielefeld (hereinafter referred to as “City Home-Bielefeld”) for the rental of rooms for accommodation as well as for all other services and deliveries of the Boardinghouse provided for the guest.
2. Conclusion of contract and content of contract
Offers submitted by City Home-Bielefeld are always subject to confirmation. A contract may be concluded in writing, in text form, orally or by telephone. However, the contract only becomes effective upon acceptance by City Home-Bielefeld. The contractual partners are the guest and City Home-Bielefeld. In the case of a booking by a third party, this third party is liable to City Home-Bielefeld as the ordering party together with the guest as joint debtor for all obligations resulting from the contract. A furnished apartment is rented in the house of City Home-Bielefeld for the number of persons specified in the booking confirmation. The guest has no claim to the provision of a specific room, unless there is a written confirmation by City Home-Bielefeld. If more than the stated number of persons are occupied, written permission must be obtained beforehand. The apartment rental price then increases according to the price list of the provider. If the guest wishes an extension of his stay, the option is open to him, provided that free apartments are available. In order to exercise the option, City Home-Bielefeld must inform the guest in writing 14 days before the end of the stay how long he intends to continue using the apartment. In the event that City Home-Bielefeld has already concluded an accommodation contract with another guest for the same apartment, City Home-Bielefeld is entitled to accommodate the guest in a comparable apartment if the length of stay is extended. Continuation or renewal of the accommodation contract must be expressly agreed in writing.
Verbal agreements are null and void. Reserved apartments/rooms are available to the contract partner from 15.00 on the day of arrival. On the day of departure the apartments/rooms are to be vacated by 11.00 a.m., unless expressly agreed otherwise. City Home-Bielefeld is free to confirm the apartment or room booking in writing. If the rooms/apartments/apartments are used after 11:00 a.m. on the day of departure, City Home-Bielefeld may charge 50% of the accommodation price until 2:30 p.m. if the rooms/apartments/apartments are used a), b) 100% of the accommodation price from 2:30 p.m. onwards. Any subletting to third parties or use of the furnished apartment by third parties is strictly prohibited and requires the prior written consent of City Home-Bielefeld. The use of the apartment for purposes other than accommodation is also prohibited, unless City Home-Bielefeld has expressly granted written permission. All City Home-Bielefeld apartments are non-smoking apartments. Smoking is therefore not permitted. Should the guest nevertheless smoke, the resulting damage or additional costs for the renovation/cleaning shall be borne by the guest.
Leave the apartment in full to reimburse. Pets are forbidden – unless the provider has given written permission. If the guest keeps pets in the apartment, the provider is entitled to charge the corresponding additional costs of final cleaning in full according to expenditure.
Messages, mail and consignments of goods intended for the guest are handled with the care of a businessman. City Home-Bielefeld takes over the storage and – on request – the forwarding of these for a fee.
3. Prices & Payment
With the conclusion of the accommodation contract, the guest undertakes to pay the agreed remuneration for the accommodation, for the deposit and for other services used by him. The payment and the deposit must be paid either in cash or by bank transfer before moving in. If the rental extends over a longer period (more than 14 days), the payments for the accommodation must be made one month in advance by bank transfer or in cash. Unless otherwise agreed, the agreed prices include the respective statutory value added tax.
The Euro shall be the invoicing currency. In the case of foreign currencies, exchange rate differences and bank charges shall be borne by the party obliged to pay. The guest is also free to make payments by EC card or credit card. The agreed prices include the respective statutory value added tax. If there is an increase in value added tax after the conclusion of the accommodation contract, the tax rate applicable at the time of room use shall apply.
Invoices of the supplier are due and payable immediately after receipt without deduction. In the case of a guest who is a consumer, the aforementioned shall only apply if the guest has been specifically informed of the consequences in the invoice. In the event of default in payment, City Home-Bielefeld is entitled to charge consumers default interest at a rate of 5% above the base rate. City Home-Bielefeld reserves the right to claim higher damages. City Home-Bielefeld is entitled to charge a reminder fee of € 5.00 for each reminder issued after default has occurred. Complaints regarding invoicing must be made to City Home-Bielefeld immediately after becoming known. The correct addressee of the invoice is to be announced when the contract is signed. City Home-Bielefeld has the right to increase the price of the apartment with an announcement of 4 weeks, i.e. to adjust it to the current price list. If the guest does not agree with the increase, the guest has a special right of termination within 2 weeks.
Only with an undisputed or legally binding claim can the customer offset or reduce a claim of the Boardinghouse.
If premises are rented for accommodation or events (only with the prior approval of City Home-Bielefeld), City Home-Bielefeld assumes that this is subject to VAT. Should the legal opinion not be correct, City Home-Bielefeld hereby waives this tax exemption and opts for VAT in accordance with § 9 UStG.
Reservations are binding for the contracting parties. The following conditions apply to cancellations of reserved rooms/apartments and/or services. The guest’s payment obligation under the hotel accommodation contract is not reduced by the actual expenses saved by City Home-Bielefeld, but in accordance with these conditions:
A partial cancellation of reserved rooms/apartments and/or services is generally excluded.
For reservations of up to 7 nights per room/apartment outside of trade fair and special periods, free cancellation is possible up to 48 hours before the start of the service period (planned arrival).
In the event of a later cancellation, the guest’s payment obligation shall be reduced to 80% of the value of the services ordered, in the case of pure overnight stays to 80% of the overnight stay price of the first night. If the guest does not make use of the service without submitting a written cancellation, the guest’s payment obligation shall be reduced to 80% of the value of the ordered services, in the case of pure overnight stays to 80% of the overnight stay price of the 1st night.
Reservations for more than 7 nights per suite can be cancelled free of charge up to 7 days before the start of the service period (planned arrival). In the event of cancellation up to 4 days prior to arrival, the guest’s payment obligation is reduced to 70% of the agreed price for the first three nights. In the event of cancellation on the day of arrival (from 0.00 a.m.) until 6 p.m., the guest’s payment obligation shall be 80% of the agreed price for the first three nights. If the tenant does not make use of the service without submitting a written cancellation, the guest’s payment obligation is reduced to 80% of the agreed price for the first three nights.
For groups (≥ 8 rooms/apartment) or for reservations of rooms/apartments for trade fair and special periods, complete cancellation is possible free of charge up to 28 days before the agreed start of the service period. In the event of cancellation up to 14 days prior to arrival, the guest’s payment obligation shall be reduced to 70% of the agreed price for the total contingent. In the event of cancellation up to 7 days prior to arrival, the guest’s payment obligation shall be 80 % of the agreed price for the total contingent. In the event of cancellation on the day of arrival (from 0.00 a.m.) until 6 p.m., the guest’s payment obligation shall be reduced to 90 % of the agreed price for the total contingent. If the tenant does not make use of the service without submitting a written cancellation, the total arrangement price for the total contingent will be invoiced.
The Boardinghouse will make every effort to re-allocate unoccupied rooms/apartments if possible. If the Boardinghouse succeeds in re-letting the suites for the agreed performance period, the aforementioned payment obligations shall be reduced to the amount by which the sum of the continuing payment obligation exceeds the proceeds from the re-letting of the suites exceeds the price agreed with the guest. A reduction is only possible up to the amount of the original payment obligation.
City Home-Bielefeld is entitled to withdraw from the contract within the above-mentioned periods for free cancellation if there are inquiries from other customers about the contractually booked rooms and the customer does not waive his right to withdraw from the contract if City Home-Bielefeld asks for further information. This applies accordingly to the granting of an option, if other inquiries exist and the contractual partner is not prepared to make a firm booking within a time limit set by City Home-Bielefeld in response to a query from City Home-Bielefeld. In this case, the booking means that as of this day, an contract is concluded and the originally agreed free cancellation period is suspended.
5. Withdrawal of the supplier
If there is an objectively justified reason, City Home-Bielefeld is entitled to withdraw from the contract. Examples are – force majeure or other circumstances for which Boardinghouse City Home-Bielefeld is not responsible, which make the fulfilment of the contract impossible. – Rental of the apartment takes place under misleading or false statements of essential facts, e.g. the name or the purpose. – City Home-Bielefeld has reasonable grounds to believe that the rental agreement
The use of a new accommodation can endanger the public reputation of City Home-Bielefeld. – Unauthorized subletting or subletting according to 2. is present. – The guest is in default of payment. In the event of payment default of more than 1 day, City Home-Bielefeld has an immediate extraordinary right of termination with a period of notice of 1 day and is entitled to withdraw the guest’s access to the apartment. – The Boardinghouse City Home- Bielefeld is informed of the circumstances that a significant deterioration of the financial circumstances of the guest has occurred after conclusion of the contract, in particular if the guest does not settle the due claims of City Home- Bielefeld or does not offer sufficient security and therefore payment claims of City Home- Bielefeld are in danger. – The guest has filed an application for the opening of insolvency proceedings against his assets, made an affidavit according to § 807 ZPO, initiated out-of-court proceedings for the purpose of debt settlement or stopped his payments. – Insolvency proceedings have been opened against the assets of the guest or the opening of proceedings has been rejected due to lack of assets. The provider will inform the guest immediately of the exercise of the right of withdrawal. In case of a justified withdrawal of the provider no claim of the customer for compensation will be justified.
5. Internet use
The guest can use the Internet free of charge in the rooms. City Home-Bielefeld does not assume any liability that an Internet connection will not be established in the event of an overload of the network. The Internet may only be used to the extent permitted by law.
6. Brought along decoration material, objects, lost property
The installation and attachment of decorative material and other objects to the walls is prohibited due to the possible risk of damage. The guest shall be liable for damage if objects are nevertheless brought in in this way. No changes of any kind may be made to or in the premises.
City Home-Bielefeld reserves the right to charge a handling fee of 20.00 € as well as shipping costs for the return of lost property.
The guest/contractual partner is liable to City Home-Bielefeld for any damage caused by him or his guests. If the provision of services becomes impossible due to force majeure, City Home-Bielefeld shall not be liable to the guest or the contractual partner. City Home-Bielefeld is entitled, but not obliged, to offer the guest equivalent services elsewhere. City Home-Bielefeld GmbH accepts no liability for loss, theft, damage or destruction of items brought in by the guest or fellow traveller. Should disturbances or defects occur in the services of the Apart-Hotel & Boardinghouse City Home-Bielefeld, it will endeavour to remedy them upon knowledge or immediate notification by the guest. For his part, the guest is obliged to do everything reasonable to reduce the damage. Possibly justified claims for damages expire if the customer does not immediately report the event that caused the damage after becoming aware of it. As far as the customer asserts claims for damages because of damage to property during the rental period, these are to be indicated and proven at the latest at the time of the departure of the City Home Bielefeld or its representative on site. Later claims for damages are excluded.
As far as the guest makes use of the parking possibility on the property, no custody contract comes off thereby. City Home-Bielefeld is not liable for the loss of or damage to vehicles parked or manoeuvred on the property and their contents.
Should additional services such as wake-up orders, messages, forwarding of mail and goods be taken over by agreement in exceptional cases, they must be carried out with the greatest care. Claims for damages, except for gross negligence or intent, are excluded.
All contractual claims against City Home-Bielefeld are subject to a limitation period of one year from the beginning of the statutory limitation period. Claims for damages become statute-barred within five years irrespective of the salary. In the case of claims which are not based on an intentional or grossly negligent breach of duty by City Home-Bielefeld, the shortening of the limitation period shall not apply. The guest is liable for facilities damaged by him or persons travelling with him as well as other impairments of the rented apartment. He undertakes vis-à-vis City Home Bielefeld to notify City Home Bielefeld of this immediately, at the latest, however, before leaving the house at check-out. Insofar as these damages become known only after the guest’s departure due to failure to notify City Home Bielefeld, the guest accepts liability. The guest’s liability for damages extends to the repair costs plus any depreciation or, in the case of a total loss, to the replacement value of the furnishings less their residual value. Furthermore, the guest is liable – as far as incurred – for all renovation and damage removal costs, expert fees and any other costs and a loss of rent incurred in connection with this. If the apartment is handed over to third parties or persons sharing the apartment with them, the guest shall be liable for compliance with the provisions of this contract and the conduct of the third party(s) as for his/her own conduct.
If you lose your apartment or room key (card), a fee of € 30.00 will be charged. For the unlocking service 50,00 € will be charged.
8. Final provisions, miscellaneous
Amendments and supplements to the contract, the acceptance of the order and other essential declarations of intent for the accommodation contract shall be made in text form. Should any of the provisions laid down here be or become invalid, this shall not affect the validity of the remaining provisions of the contract or these General Terms and Conditions. The invalid provision shall be replaced by a provision which most closely corresponds to the invalid provision.
